2. Eligibility. Subject to the additional restrictions below, The Tennessean Vacation Photo Contest (the "Contest") is open to amateur photographers who are a resident of Tennessee. The children and legal dependents of employees of The Tennessean ("Sponsor"), Gannett Co. Inc., and each of their respective affiliated companies, and advertising and promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees, are not eligible to enter or to win. For purposes of the contest, an amateur photographer is a person who does not derive the largest portion of his/her income from the sale of photographs.
3. How to enter. The Contest will begin at 12:01 a.m. (EDT) Sunday, June 26, 2011, and end at 5 p.m. (EDT) August 14, 2011 (the "Contest Period"). To enter, photographs should have been taken between August 16, 2010, and Aug. 14, 2011. Each photographer may submit up to three (3) entries per week. Finalists will be selected by The Tennessean staff and will be posted online and voting will take place from 12:01 am (EDT) August 17 - 5 p.m. (EDT) August 21, 2010.
Photographs will be judged on originality, composition and technical execution by The Tennessean staff members. They should capture the beauty, intrigue or curiosity of a location enough to make you want to travel there. They can be taken across the world or across the street.
Submissions may only be entered online at Tennessean.com. To submit photos, log on to
Tennessean.com /travel and click the contest promo. Recommended photo size is at least 170 dpi at 6x8 inches in a jpeg format.
Manipulation of images should be limited to conventional darkroom techniques or basic sharpening and cropping. Images should contain only the subject matter as originally seen through the viewfinder. Double exposures, digitally stitched photos and images containing any manipulated or added content will not be accepted and should not be entered.
Each photo submission must be an authentic, original photograph taken by contestant identified on the accompanying entry form, and the contestant must own the copyright in the photograph submitted. Entrants retain copyright to their pictures, but entries may be published in The Tennessean or posted on its Web site.
Sponsor will not be responsible for incomplete, lost, late, postage-due, misdirected or illegible entries, or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account.
All entries become property of Sponsor. Entries will not be returned. Contestants acknowledge and agree that Sponsor shall have the right to edit, adapt, modify, reproduce, publish, promote, or otherwise display or use entries in any way it sees fit without limitation or compensation to entrants.
Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest. Sponsor further reserves the right to disqualify any entry that is alleged to infringe on any third-party's intellectual property rights, or that Sponsor deems obscene, offensive or otherwise inappropriate for viewing by a general audience.
4. Winner selection. Tennessean staff will judge all eligible entries according to the following criteria: Originality, composition and technical skill. The photos should capture the beauty, intrigue or curiosity of a location enough to make you want to travel there. They can be taken across the world or across the street. Decisions of judges and Sponsor shall be final and binding in all respects.
On August 17, finalists determined by The Tennessean staff will be posted on Tennessean.com and readers will be able to make their pick.
5. Prizes will awarded as follows:
Tennessean Judges Prizes:
First Prize: Cruise is for two (2) persons for three (3) nights to the Bahamas, inside accommodations (no window or porthole). The winner is responsible for taxes and fees. The award does not include transportation from the winner's home to the ship. Airfare is available to purchase. The winner can upgrade to an ocean view room for the price difference between the inside and and ocean view room. Holiday sailings and certain blackout dates are excluded. Winner will select three (3) desired travel dates. Just Cruisin' Plus will exercise our best efforts to obtain space on the dates in the priority listed. It is possible none of the three will be available and Just Crusin' Plus will ask that the winner select an additional three dates.
The award does not include government taxes and fees, any purchases of a personal nature, transportation to and from the ship, and is subject to the following restrictions:
The recipient will select three desired travel dates and we will use our best efforts to reserve the cruise on their preferred date. If that date is not available, the second and third choice (if necessary) will be used. If none of the three choices are available we will ask the winner to provide additional dates.
Holiday sailings and “black out” sailing dates specified by the cruise line will not be available.
Recipient is responsible for compliance with cruise line and governmental rules regarding proof of citizenship and identity,
The award is not redeemable for cash in whole or in part.
The accommodation may be upgraded by the recipient from a basic inside room to ocean view or balcony by paying only the fare difference (subject to availability).
The award cannot be transferred, bought or sold.
The cruise must be taken and completed within one year of the award date.
Prize is valued at $1100.
Second Prize: Gulf Shores: Enjoy a 3-night stay in a Gulf Shores condo plus a $20 gift card to Ribs & Reds, four passes and a $25 gift card to Waterville and a Kodak Easy Share camera. Prize is valued at $900.
Third Prize: Maderia Bay - 3 night stay for a family of 4 in a marina view condo at our Madeira Bay Resort. We will have to put a disclaimer "Based on availability. Not valid during holidays. Offer expires 2/15/12. Prize is valued at $900.
Fourth Prize: Sam's Town Hotel & Casino - Two-night stay for two at Sam's Town Hotel & Casino in Robinsonville (Tunica County), Mississippi and dinner for two at Twain's Steakhouse (not to exceed $200). Prize valued at $450.00.
Fifth Prize: Harrah's Metropolis - Two-night stay at Harrah's Metropolis in Illinois and a $100 voucher to The Range Steakhouse. Prize valued at $400.00.
Reader's Choice Awards:

6. Winners notification and acceptance. Winners will be notified on or about Sept. 2 at the telephone number, email address and/or U.S. Mail address provided on winners' entry form.
Sponsor will call during regular business hours at number provided on entry form and will leave no messages. Failure to reach winner by phone may result in disqualification of winner, forfeiture of his or her interest in all prizes, and selection of a substitute winner from among all remaining eligible entries. Return of prize notification as undeliverable may result in disqualification and an alternate winner may be selected. Prizes will be mailed to each winner within ten (10) business days after notification.
Winners may waive their right to receive prizes. Prizes are non-assignable and nontransferable. No substitutions allowed by winner. Sponsor reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes.
Winners may be required to complete an affidavit of eligibility/liability certifying that the entrant's submission is entrant's original work, that entrant owns right to the work, and that entrant has complied with the Official Rules of the Contest, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of personal delivery or date of postmark. Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner.
Prizes won by minors will be awarded to parent or legal guardian who must sign any affidavit or release required by Sponsor.
Except where prohibited, acceptance of any prize constitutes winner's consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation the Internet, or further compensation. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor.
7. Participation. By participating, contestants agree to be bound by these Official Rules and the decisions of Sponsor. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date.
By entering the Contest, each contestant grants to Sponsor an exclusive, royalty-free and irrevocable right and license to publish, print, edit or otherwise use the contestant's submitted entry, in whole or in part, for any purpose and in any manner or media (including, without limitation, the Internet) throughout the world in perpetuity, and to license others to do so, all without limitation or further compensation. Each contestant further agrees that if his/her entry is selected by Sponsor as the winning entry, he/she will sign any additional license or release that Sponsors may require, and will not publicly perform or display his or her submission without the express permission of Sponsors.
8. Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
9. Sponsor. The Tennessean Vacation Photo Contest is sponsored by The Tennessean. The decisions of Sponsor and the Contest judges regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
