Eligibility

There is a maximum of one (1) entry per household. For purposes of these Official Rules, a "household" includes all people who share the same residence for at least three (3) months a year, regardless of familial relationships. Subject to the additional restrictions below, the contest "Ugliest Kitchen Contest", is open to legal residents within Selection Center's marketing area defined as "Middle Tennessee" by Selection Center, who are 18 years of age or older at the time of entry and who own their own home (house townhouse or condo).

Employees, officers and representatives of all sponsors listed below, and their immediate family members are not eligible to win. The term "immediate family members" includes spouses, parents, grandparents, siblings and children.

How to Enter

The contest will begin on Saturday, July 17, 2010.

There are three (3) steps necessary to enter the contest.

Step 1: Fill out an official entry form. Complete an entry form available at Selection Center or www.selectioncenter.com or enter online at www.tennessean.com/ugliestkitchen.

Step 2: Provide at least two (2) photos of your current kitchen, each photo at a different perspective/angle. If you wish to submit digital photos please: 1) complete the registration process online at www.tennessean.com/ugliestkitchen 2) include images on a CD or 3) email to: ugliestkitchen@selectioncenter.com.

NOTE: When submitting digital pictures through email, be sure to include your legal name, address, and phone number(s). If submitting photographic prints, please attach them to your completed official entry form. Be sure to mark on each print your legal name, address and phone number(s). All entries must depict the kitchen of a home owned by the eligible contestant in the Selection Center market area.

Step 3: Bring in your completed official entry form with photos to Selection Center or complete your online submission.

If mailing a CD or prints and completed entry form send in a postage paid envelope to: "Ugliest Kitchen Contest", Selection Center, 2960 Sidco Drive, Nashville, TN 37204.

All entries must be postmarked or submitted online by August 8, 2010 and become the property of Selection Center and the Sponsors. Photographs and questionnaire answers must be the original work of the Contestant. Do not copy the work of others. Sponsors will not be responsible for incomplete, lost, late, postage due, misdirected or illegible entries.

Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest.

All entries become the property of Selection Center and the Sponsors and none will be returned. By entering the Contest, you grant Selection Center and the Sponsors an irrevocable, non-exclusive royalty-free license to broadcast, display on its website(s), copy, edit and otherwise use your entry materials, including photographs and essay for marketing or promotional purposes.

Winner Selection

On August 11, 2010, ten (10) finalists will be selected. A panel of judges appointed by the sponsor will evaluate all eligible entries received based on the following criteria: (1) degree of challenge depicted in the entry photos and the potential for improvement of the contestant's kitchen appearance and design and (2) the quality of the contestant's questionnaire explanation as to why his or her kitchen deserves to be the Grand Prize Winner.

Between the dates of August 11, 2010 and August 18, 2010 all ten finalists photos will be posted at www.tennessean.com/ugliestkitchen for the public to view and cast their vote online for the kitchen they believe to be the "Ugliest Kitchen Contest"

Winner. The Grand Prize Winner will be selected based on online votes of the ten (10) finalists in conjunction with the Contest Judges.

Selection Center will announce the Winner on Saturday, August 21, 2010. There will be only one (1) Grand Prize Winner.

Prizes and Odds

Grand Prize: One (1) Grand Prize Winner will receive new Designer Cabinetry and hardware from Designer Kitchen Distributors and one-on-one design services with a kitchen designer, a QuarryStone Collection granite countertop and stainless steel undermount sink from Granite Direct Store, a tile backsplash and design consultation from Floors by Design, a custom pantry from More Space Place, and an appliance package consisting of a range, range hood, and dishwasher from Siano Appliance Distributors.

All of these items will have a Manufacturer's Suggested List Price not to exceed $25,000.00. All materials will be selected by one of Selection Center's Kitchen Designers and agreed upon by the Grand Prize Winner.

By accepting the Grand Prize the Grand Prize Winner expressly agrees to release and hold harmless Selection Center and the Sponsors and other Released Parties from any and all liabilities, claims, damages, costs and expenses arising out the contest, the kitchen remodel, or the Grand Prize Winner's acceptance or use of any Prize.

The Grand Prize Package has an estimated value of $25,000.00 Manufacturer’s Suggested List Price for the Designer Cabinetry and hardware from Designer Kitchen Distributors, a QuarryStone Collection granite countertop and stainless steel undermount sink from Granite Direct Store, a tile backsplash from Floors by Design, a custom pantry from More Space Place, and an appliance package consisting of a range, range hood, and dishwasher from Siano Appliance Distributors. Installation labor for cabinetry, countertops, sink, backsplash, pantry, and appliances will be included in Grand Prize Package.

Winner is responsible for all other materials required for the project, including but not limited to tear-out of old cabinets, disposal of the old kitchen and any additional labor required to complete the project.

The foregoing allowances represent good faith estimates of the values of various components of the kitchen remodel to be awarded and the actual value of the Grand Prize project may differ depending on the specific details of the project. Under no circumstances will the Sponsor be obligated to award a Grand Prize kitchen remodel package valued at more than $25,000.00 Manufacturer's Suggested List Price and any difference between the estimated and final, actual value of the kitchen remodel project will not be awarded. All costs and expenses associated with the kitchen remodel project in excess of the project allowances set forth will be the sole responsibility of the Grand Prize Winner. The Grand Prize Winner must cooperate fully with the Sponsor and suppliers and is solely responsible for obtaining and paying the costs of any permits, inspections or licenses required by applicable laws,regulations or ordinances to complete the kitchen project. The Grand Prize is provided "as is" without any express or implied warranty of any kind from the sponsor.

Odds of winning depend on the number of entries received.

Winner Notification and Prize Acceptance

The Grand Prize Winner will be notified on August 21, 2010 by telephone as well as announced in The Tennessean and online at www.tennessean.com/ugliestkitchen and www.selectioncenter.com. All other finalists will be notified by mail. The Grand Prize Winner may waive his or her right to receive the Grand Prize.

The Grand Prize is non-transferable and the kitchen remodeling project may only be performed at the residence depicted in the Grand Prize Winner's entry. No cash equivalents or substitutions will be allowed to the Grand Prize Winner.

The Grand Prize and individual components of the Grand Prize package are subject to availability and the Sponsor reserves the right to substitute any Prize or Prize component with a Prize or component of equal or greater retail value.

Failure to comply with the terms or conditions of these official rules may result in the disqualification of the Grand Prize Winner, the forfeiture of his or her interest in the Grand Prize, and the award of the Grand Prize to a substitute Winner.

Except where prohibited, acceptance of any Prize constitutes the Grand Prize Winner's consent to the Sponsor's use of his or her name in any media for promotional purposes without limitation or further compensation.

If the Grand Prize is not won and claimed by an individual in accordance with these Official Rules, the Grand Prize will not be awarded and will remain the property of the Sponsor.

The Grand Prize must be claimed, ordered and installed by March 31, 2011.

Participation

By participating, entrants agree to be bound by these Official Rules and by the decisions of Selection Center, Sponsors and the Contest Judges, appointed by the Selection Center, which shall be final in all respects. Selection Center and Sponsors reserve the right to disqualify persons found tampering with or otherwise abusing any aspect of the Contest as solely determined by Selection Center and the Sponsors.

In the event the Contest is compromised by tampering or any other cause beyond reasonable control of Selection Center and Sponsors which corrupts or impairs the administration, security, fairness or proper operation of the Contest, the Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest.

Sponsor

Middle Tennessee's Ugliest Kitchen Contest is presented by Selection Center and sponsored by Designer Kitchen Distributors, Floors by Design, Granite Direct, More Space Place, Siano Appliance Distributors, The Tennessean and Whole Foods. The decision of Selection Center and Sponsors and the Contest Judges regarding the selection of the Winner, the interpretation of these Official Rules and all other aspects of the Contest shall be final and binding in all respects.

Selection Center and Sponsors will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in any other material or announcements relating to the Contest.

Tax Responsibilities

Contest Winner is responsible for all taxes: state, local and federal. Contest Winner will be billed by the appropriate Sponsors and must pay the TN sales tax on the total value of applicable winnings up to $25,000.00 at Manufacturer's Suggested List Price. The contest Winner will also be required to provide Selection Center and Sponsors with their Social Security number so Selection Center can 1099 the Winner for the total value of their wining up to $25,000.00 at Manufacturer's Suggested List Price.

If the Winner does not comply the Winner will not be able to claim the Prize, the Prize will not be given away and the Prize will become the property of Selection Center.

In the event that Grand Prize Winner does not have a pantry within their kitchen, the custom pantry may be switched out for a custom closet design with a Manufacturer's Suggested List Price up to $1,000 from More Space Place.
